Notice of Proposed Rulemaking: Lake and Streambed Alteration Agreement Fees (Title 14, Section 699.5, CCR)

Existing law allows the Department to charge a fee to recover the costs it incurs to administer and enforce Fish and Game Code (FGC) Section1600 et seq, relating to Lake and Streambed Alteration Agreements. California Code of Regulations, Title 14, subsections 699.5(b), (c), (e), (f), (i), (j), and (k) specify fees which are subject to annual price adjustments in accordance with FGC Section 713. These fees have not been adjusted since 2009. The Department proposes to adjust these fees for inflation by applying the annual price index for the four years 2010, 2011, 2012, and 2013. The resulting increase will be approximately 9.5%.
In accordance with the Administrative Procedure Act, CDFW provided notice of the proposed regulatory action to the Office of Administrative Law for publication in the California Regulatory Notice Register on August 23, 2013. The public notice begins a 45-day review process during which interested individuals may comment on the proposed rulemaking.

A public hearing has been scheduled for Tuesday, October 8, 2013, from 1:30 p.m. to 3:30 p.m., at the Resources Building located at 1416 9th Street, Sacramento, California, in the 12th floor conference room, Room 1206. The conference room is wheelchair accessible.
